Terms of Service

Welcome to Trevelio. These Terms of Service ("Terms") govern your access to and use of the Trevelio platform, website, and related services (collectively, the "Service") operated by Trevelio s.r.o., a company incorporated under the laws of the Slovak Republic ("Trevelio," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Definitions

"Platform" means the Trevelio software-as-a-service application, including all web interfaces, APIs, and related tools.

"Organizer" means any individual or legal entity that registers an account on the Platform for the purpose of creating and managing trip listings, accommodations, and bookings through a tenant workspace.

"Tenant" means a workspace created by an Organizer on the Platform, representing a distinct brand, business, or organizational unit.

"Guest" or "Traveler" means any individual who books a trip or experience through the Platform via an Organizer's tenant page.

"User" means any individual who accesses or uses the Service, including Organizers, Guests, and team members invited to a Tenant.

"Content" means any text, images, photographs, descriptions, itineraries, pricing information, or other materials uploaded, submitted, or published on the Platform by any User.

"Subscription Plan" means the pricing tier selected by an Organizer, as described in Section 4 of these Terms.

2. Scope of Service

Trevelio is a business-to-business (B2B) software-as-a-service platform that enables Organizers to create branded tenant pages, build trip and experience listings, manage accommodations, and accept bookings with integrated payment processing. Trevelio is not a travel agency, tour operator, or provider of travel services.

Trevelio acts solely as a technology provider. We do not organize, operate, or provide any trips, accommodations, or travel-related services. All travel services are provided by Organizers, who bear sole responsibility for fulfilling their obligations to Guests.

The Platform facilitates the connection between Organizers and Guests but does not participate in, endorse, or guarantee any transaction or travel service arranged through the Platform.

3. Account Registration

3.1 Eligibility

You must be at least 16 years of age to create an account on the Platform. By registering, you represent that you meet this age requirement and that all information you provide is accurate and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account at support@trevelio.com.

3.3 Organizer Accounts

Organizers who create a Tenant represent and warrant that they have the legal authority to operate a travel-related business in their jurisdiction and that they will comply with all applicable laws and regulations, including consumer protection, tax, and licensing requirements.

3.4 Team Members

Organizers may invite additional users to their Tenant with various roles (Owner, Admin, Organizer, Accountant, Staff). The Tenant Owner is responsible for the actions of all team members within their Tenant.

4. Subscription Plans & Billing

4.1 Plans

Trevelio offers the following subscription plans for Organizers:

  • Free — No monthly fee. Limited features. Subject to platform transaction fees as published on our pricing page.
  • Starter — €9 per month. Expanded features and capabilities.
  • Growth — €49 per month plus a 5% platform fee on bookings processed through the Platform.
  • Pro — €99 per month plus a 2% platform fee on bookings processed through the Platform.

Plan features, pricing, and transaction fee percentages are subject to change. We will notify Organizers of any pricing changes at least 30 days in advance.

4.2 Billing Cycle

Subscriptions are billed monthly in advance. All fees are quoted in euros (EUR) and are exclusive of applicable taxes unless otherwise stated. Platform fees on bookings are calculated and invoiced separately.

4.3 Payment Method

Organizers must provide a valid payment method for subscription billing. By providing a payment method, you authorize Trevelio to charge applicable fees on a recurring basis until your subscription is cancelled.

4.4 Failed Payments

If a payment fails, we will attempt to process the charge again. If payment cannot be collected after reasonable attempts, we may suspend or downgrade your Tenant until the outstanding balance is settled.

5. Payment Processing via Stripe Connect

5.1 Stripe Connect

Payment processing for bookings is handled by Stripe, Inc. ("Stripe") through Stripe Connect. Organizers must complete Stripe's onboarding process to receive payments from Guests.

5.2 Merchant of Record

The Organizer is the merchant of record for all booking transactions. Trevelio facilitates payment processing but does not hold, manage, or control Guest funds. Funds are transferred directly to the Organizer's connected Stripe account, less any applicable platform fees and Stripe processing fees.

5.3 Platform Fees

Trevelio collects platform fees as a percentage of each booking transaction, as determined by the Organizer's subscription plan. Platform fees are deducted automatically by Stripe before funds are transferred to the Organizer.

5.4 Stripe Terms

By using payment features of the Platform, you also agree to be bound by Stripe's Connected Account Agreement and Privacy Policy.

5.5 Refunds & Disputes

Organizers are responsible for handling refunds and disputes with Guests in accordance with their published cancellation and refund policies. Trevelio may facilitate the technical processing of refunds but bears no financial responsibility for refunded amounts.

6. Organizer Obligations

As an Organizer using the Platform, you agree to:

  • Provide accurate, complete, and up-to-date information about your trips, experiences, accommodations, and pricing.
  • Comply with all applicable laws and regulations in your jurisdiction, including consumer protection, travel industry licensing, tax obligations, and data protection laws.
  • Fulfill all bookings accepted through the Platform in accordance with the terms communicated to Guests.
  • Maintain a clear and fair cancellation and refund policy, which must be communicated to Guests before booking.
  • Respond to Guest inquiries and complaints in a timely and professional manner.
  • Not use the Platform for any unlawful, fraudulent, or deceptive purposes.
  • Not upload or publish Content that infringes on the intellectual property rights or other rights of any third party.
  • Comply with Stripe's terms of service and acceptable use policies in connection with payment processing.

7. User Content

7.1 Ownership

You retain ownership of all Content you upload to the Platform. By uploading Content, you grant Trevelio a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your Content solely for the purpose of operating and providing the Service.

7.2 Responsibility

You are solely responsible for all Content you publish on the Platform. You represent and warrant that you have all necessary rights to the Content and that it does not violate any applicable law or infringe on any third-party rights.

7.3 Prohibited Content

You may not upload or publish Content that is illegal, defamatory, obscene, harassing, threatening, or otherwise objectionable. Trevelio reserves the right to remove any Content that violates these Terms or that we deem inappropriate, without prior notice.

7.4 License Termination

The license granted in Section 7.1 terminates when you delete your Content from the Platform or when your account is terminated, except where Content has been shared with or relied upon by other Users (e.g., booking confirmations).

8. Intellectual Property

The Platform, including all software, design, text, graphics, logos, icons, and other materials created by Trevelio, is the exclusive property of Trevelio s.r.o. and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform beyond the limited right to use it in accordance with these Terms.

You may not copy, modify, distribute, sell, or create derivative works based on the Platform or any part thereof without our prior written consent.

9. Limitation of Liability

9.1 Platform Role

Trevelio provides the Platform on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or secure. We expressly disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 No Liability for Travel Services

Trevelio is not responsible for the quality, safety, legality, or fulfillment of any trip, accommodation, or experience offered by Organizers. All disputes regarding travel services are between the Guest and the Organizer.

9.3 Limitation

To the maximum extent permitted by applicable law, Trevelio's total aggregate liability arising out of or in connection with these Terms or the Service shall not exceed the greater of (a) the total fees paid by you to Trevelio in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (€100).

9.4 Exclusion of Consequential Damages

In no event shall Trevelio be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, regardless of the cause of action or theory of liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Trevelio s.r.o., its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service or violation of these Terms.
  • Content you upload, publish, or otherwise make available through the Platform.
  • Your breach of any representation, warranty, or obligation under these Terms.
  • Any dispute between an Organizer and a Guest arising from a booking or travel service facilitated through the Platform.
  • Your violation of any applicable law or third-party rights.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us at support@trevelio.com or through your account settings. Organizers must ensure that all pending bookings are fulfilled or appropriately cancelled before terminating their Tenant.

11.2 Termination by Trevelio

We may suspend or terminate your account or access to the Service at any time, with or without cause, including if we reasonably believe that you have violated these Terms. We will make reasonable efforts to notify you prior to termination, except where immediate action is required to protect the Platform or other Users.

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain your data as required by applicable law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) shall survive.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of laws provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

12.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Slovak Republic, unless mandatory consumer protection laws of your jurisdiction provide otherwise.

12.3 Consumer Rights

Nothing in these Terms shall affect the statutory rights of consumers under applicable EU or national consumer protection legislation. If you are a consumer residing in the European Union, you may also have the right to submit disputes to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on the Platform at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

If you do not agree with the revised Terms, you must stop using the Service and terminate your account before the changes take effect.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any applicable Booking Terms or Data Processing Agreement, constitute the entire agreement between you and Trevelio regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

The failure of Trevelio to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. Trevelio may assign its rights and obligations under these Terms without restriction.
